The eIDAS Regulation (EU) 910/2014 and the Digital Administration Code (CAD) govern electronic signatures, with their three levels. Article 2702 of the Civil Code recognizes the value of electronic documents that ensure identity and integrity.

Types of electronic signature in Italy
Simple electronic signature
Valid and freely weighed by the judge (art. 20 of the CAD). Firmiu's audit trail supplies the authorship and integrity evidence the court considers.
Advanced electronic signature (FEA)
Guarantees a unique link to the signer and exclusive control. It satisfies written form for most private contracts.
Qualified signature / firma digitale
With a qualified certificate from a provider overseen by AgID. Mandatory for the acts in article 1350 of the Civil Code (numbers 1–12), such as real-estate contracts.
What makes a signature valid in Italy?
For private agreements, a simple or advanced signature is valid; the qualified one equals a handwritten signature. Firmiu adds a full audit trail to every signature.

- Yes. eIDAS and the CAD grant them full validity.
- What is the Italian digital signature?

- Do they work across the EU?
- Yes, eIDAS guarantees recognition in all member states.
- What is PEC and when is it used?
- Posta Elettronica Certificata gives email the legal value of formal notice and is mandatory for companies. It complements, but doesn't replace, signing the document.
- Can leases be signed electronically in Italy?
- Lease contracts require written form: an advanced or qualified electronic signature satisfies it. For agreements with no form requirement, a simple audited signature is enough.
- When is the firma digitale mandatory?
- For the acts of article 1350 of the Civil Code — typically real estate — and several public procedures. Other private contracts don't need it.
- Can I sign with SPID?
- There is a SPID-based signing scheme for certain services, managed by AgID. For everyday commercial contracts, an audited electronic signature is the practical route.
